By accessing or using the Heirvana platform, website, mobile application, or any related services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to these Terms, you must not access or use our Services.

These Terms constitute a legally binding agreement between you and Heirvana, LLC ("Heirvana," "we," "us," or "our"), a limited liability company. We reserve the right to update these Terms at any time. Continued use of the Services following notice of any changes constitutes your acceptance of the updated Terms.

Heirvana provides an online platform that offers self-help legal document templates, digital asset vault storage, estate planning tools, beneficiary management, and related features to help individuals organize and plan their digital and financial legacy.

Our Services are designed to assist you in creating legal documents based on information you provide. All documents generated are based on templates and are not customized legal advice tailored to your individual circumstances.

Heirvana, LLC is not a law firm and is not authorized to practice law. We do not provide legal advice, legal representation, or legal counsel of any kind. No attorney-client relationship is created by using our Services.

The document templates, guides, and informational content available through Heirvana are provided for general informational and self-help purposes only. They are not a substitute for the advice of a licensed attorney. Laws vary significantly by state and jurisdiction, and the legality, enforceability, or suitability of any document we help you generate cannot be guaranteed.

You must be at least 18 years of age and capable of entering into a legally binding contract to use our Services. By using our Services, you represent and warrant that you meet these requirements.

To access certain features, you must create an account. You agree to provide accurate, current, and complete information and to update it as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You must notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to safeguard your account credentials.

Heirvana offers both one-time purchase options and recurring subscription plans. By purchasing a subscription, you authorize us to charge your payment method on a recurring basis at the then-current subscription rate until you cancel.

All fees are stated in U.S. dollars and are non-refundable except as required by law or as expressly stated in our refund policy. We reserve the right to change our pricing at any time with reasonable notice.

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period; you will continue to have access to paid features until then.

Heirvana provides secure digital storage for your personal information, documents, and digital asset records ("Vault"). You retain full ownership of all content you store in your Vault. By storing content, you grant Heirvana a limited license to store, process, and display that content solely as necessary to provide the Services.

While we implement industry-standard security measures, we cannot guarantee that unauthorized third parties will never be able to defeat those measures. You acknowledge that you provide information and store documents at your own risk.

The accuracy and legal validity of any document you create using Heirvana depends entirely on the information you provide. You are solely responsible for ensuring that all information entered is accurate, truthful, and complete.

Document templates are periodically reviewed but may not reflect the most current changes in the law. Heirvana makes no warranties, express or implied, regarding the legal sufficiency, accuracy, reliability, or enforceability of any document generated through our platform.

All content, features, and functionality of the Heirvana platform — including but not limited to text, graphics, logos, software, and document templates — are owned by or licensed to Heirvana, LLC and are protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, modify, or create derivative works of any part of our Services without our express written permission.

You agree not to use our Services to:

• Violate any applicable federal, state, or local law or regulation
• Submit false, misleading, or fraudulent information
• Infringe the intellectual property or privacy rights of any person
• Attempt to gain unauthorized access to our systems or another user's account
• Transmit any malware, viruses, or other harmful code
• Use the platform for any commercial purpose not expressly permitted by us

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

HEIRVANA DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE. WE DO NOT WARRANT THE ACCURACY OR COMPLETENESS OF ANY INFORMATION PROVIDED THROUGH OUR SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, HEIRVANA, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR LEGAL CONSEQUENCES ARISING FROM ANY DOCUMENT CREATED USING OUR PLATFORM.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO HEIRVANA IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

You agree to indemnify, defend, and hold harmless Heirvana, LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any rights of another person or entity.

These Terms shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Services shall first be subject to informal resolution. If unresolved, disputes shall be settled by binding arbitration in Atlanta, Georgia under the rules of the American Arbitration Association. You waive any right to a jury trial or class action proceeding.

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is otherwise harmful to other users, us, or third parties.

Upon termination, your right to use the Services will immediately cease. Provisions that by their nature should survive termination shall survive, including but not limited to ownership provisions, disclaimers, indemnification, and limitations of liability.
